Terms of Service

These Terms of Service ("Terms") govern your use of the BarkCatcher desktop application and the barkcatcher.com website (collectively, the "Service"), operated by BarkCatcher ("we," "us," or "our"). By downloading, installing, or using BarkCatcher, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of the Service
BarkCatcher is a desktop application that analyzes audio recordings you provide to detect and log barking events. The application processes audio locally on your device. BarkCatcher does not record, transmit, or store your audio files on any external server.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to purchase a license or use BarkCatcher. By using the Service, you represent that you meet this requirement.
3. License grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the BarkCatcher application on the number of devices permitted by your plan:
- Free edition — use the core bark-detection features at no cost on one device. Export and reporting features are not included.
- Homeowner edition — a paid license that unlocks case export and reporting features for personal, non-commercial use on one device. The Homeowner edition supports one active case at a time and up to three cases per license year. If you need more, upgrade to the Agency edition.
- Agency edition — a paid license that unlocks all features for professional or commercial use on up to three devices.
Licenses are personal to the purchaser and may not be resold, sublicensed, or transferred to another party. You may move a license between devices by deactivating it on the old device before activating it on a new one.
4. License activation
Paid licenses require online activation using the license key provided after purchase. Activation associates the key with a device identifier to enforce plan limits. An internet connection is required for initial activation and periodic validation but is not required for day-to-day use of the application.
5. Payments and billing
All payments are processed by Lemon Squeezy, our merchant of record. Lemon Squeezy handles checkout, payment processing, sales tax, and invoice delivery. By purchasing a license, you also agree to Lemon Squeezy's terms of service.
Prices are listed in US dollars and may change at any time. Any price change will not affect licenses already purchased.
6. Refunds
If BarkCatcher does not meet your needs, you may request a refund within 7 days of purchase by emailing [email protected]. Refunds are processed through Lemon Squeezy and returned to the original payment method. Upon refund, your license key will be deactivated.
7. Acceptable use
You agree that you will:
- Use BarkCatcher only in compliance with all applicable local, state, national, and international laws, including recording and privacy laws in your jurisdiction
- Only analyze audio recordings that you have the legal right to record and possess
- Not use the Service to harass, stalk, or intimidate any person
- Not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the application
- Not circumvent or attempt to circumvent any license restrictions, activation mechanisms, or usage limits
8. Audio recording laws
Laws governing audio recording vary by jurisdiction. Some locations require the consent of all parties before recording. It is your responsibility to understand and comply with the recording laws that apply to you. BarkCatcher does not record audio — it analyzes files you provide — but you are solely responsible for ensuring those files were obtained legally.
9. Intellectual property
The BarkCatcher application, website, documentation, and all associated intellectual property are owned by BarkCatcher and protected by copyright, trademark, and other applicable laws. These Terms do not grant you any rights to our trademarks, logos, or branding.
You retain full ownership of your audio files, case data, and any reports you generate using BarkCatcher.
10. Disclaimer of warranties
BarkCatcher is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not guarantee that barking detection will be accurate, complete, or error-free. BarkCatcher is an analysis and documentation tool — it is not a legal service, a substitute for professional advice, and should not be relied upon as the sole basis for legal action. Detection results should be reviewed by the user before being included in any formal complaint, report, or legal proceeding.
11. Limitation of liability
To the maximum extent permitted by applicable law, BarkCatcher and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the cause of action or the theory of liability.
Our total cumulative liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us for BarkCatcher in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless BarkCatcher and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. Upon termination, your license is revoked and you must uninstall BarkCatcher. Sections regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of BarkCatcher after changes are posted constitutes your acceptance of the revised Terms.
15. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Washington.
